Bjorn Fitness Waiver of Liability for Gym Use and Personal Training

I hereby understand and acknowledge that the training, programs and events held by Bjorn Fitness may expose me to many inherent risks, including accidents, injury, illness, or even death. I assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me.

I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity.

I acknowledge that I am physically fit enough and mentally capable of performing the physical activities I choose to participate in.

After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and Bjorn Fitness furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE Bjorn Fitness, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in Bjorn Fitness training, programs and/or events.

Viking Code of Conduct

We want to create a safe space that helps everyone to reach their personal fitness goals. We enforce this with the following Code of Conduct:

  1. Support and respect the dignity of everyone regardless of race, political identity,  gender identity, or sexual orientation
  2. Do not disrupt sessions with excessive complaints, mean comments, or noise
  3. Give new Vikings the opportunity and space to learn with their shapesmith and partners
  4. Encourage others to do their best at all times
  5. Show up as early as you can for sessions and clear the floor when sessions end to allow the next group to join
  6. Protect the health and safety of other Vikings
  7. Do not repeatedly request song changes during group sessions
  8. Focus your and your partner’s attention on your shapesmith when they provide instructions
  9. Share the floor so that everyone can have the space and opportunity needed to learn and grow
  10. Promptly inform staff of code violations or of possible internal issues during session

Failure to follow this code for reasons of nuisance, disturbance of others, moral turpitude or fraud, or if we determine that your actions may endanger yourself or others will be met with immediate response from the team up to and including termination of membership with no refund.

Discounts

As of April 1st 2023 Bjorn Fitness offers no special discounts of any kind. The closest we offer is a trial membership, a bartership relationship (which can only be established between the CEO and a partner), as well as the plus one awarded to each shapesmith. Plus ones are requested to give accurate feedback on the shapesmith’s product and not be disruptive.

Refunds

New client refunds

Bjorn Fitness offers a 30 day 150% money back guarantee for memberships to all clients within the first 30 days of their initial or trial membership purchase. They must however come in for an in person exit interview to receive this refund. After 30 days a refund cannot be extended for any membership dues, fees, or charges. This includes any switch to a different programming such as the addition to Nutritional guidance or advancement from large group to private sessions. In such events the 30 day countdown restarts.

Absence refunds

Clients who no-show or are absent for one week may qualify for a reimbursement if they were hospitalized, were in a crisis situation, or were incapacitated due to serious illness for a total of one week. We use the honor system with this policy. No Show fees can be waived only in this instance.

This reimbursement is given in the form of a discounted charge on the following month.

Merchandise refunds

Clients may request a refund for merchandise that fails to live up to standards within one week of purchase.

Supplement refunds

Clients may request supplement refunds for poor quality, expired, or misdelivered supplements. They may not request refunds after more than 3 weeks (21 days) of using a product. Refunds for supplements requested before the 21 day cut off are 100%.

Partial refunds

Bjorn Fitness does not offer partial refunds of any kind for any reason.

Client Absences

No call no shows

Clients who give no notice within 24 hours before a session will be charged a $15 fee automatically. They have an additional 2 hours after the end of a session to request it waived. Barring medical emergencies, this will have no exceptions. The fee can be waived if a medical emergency or hospitalization is the excuse for absence. A medical emergency is any unexpected injury or physical ailment that causes a client to rush to a doctor or be unable to move their body enough to cancel a session.

A client who no-shows twice will be contacted to assess intention to continue and current home life circumstances.

Extended leave

We do not charge for extended leaves if we are informed before the 1st of each calendar month or if the leave is requested through our system. An extended leave is one week or more in length.

Random absences and snow days

In the event of a random absence or a snow day the client and shapesmith are expected to reschedule for the next best possible day. Clients have paid for the month in advance and should work to get as many days in as possible.
